These terms are designed to protect our company, establish clear expectations, and ensure a professional and transparent relationship with our clients.

 

1. Acceptance of Terms

 

By accessing our website or booking our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service and our Privacy Policy.

 

2. Service Eligibility

 

You must be at least 18 years old to engage our services. By scheduling a service, you represent that you are legally authorised to enter into a binding agreement.

3. Scope of Services

 

We offer professional duct cleaning services for residential and commercial properties. The scope of each job will be clearly outlined in the service agreement, estimate, or booking confirmation. We reserve the right to refuse services if:

  • The property is deemed unsafe or inaccessible

  • The service request is beyond the scope of our expertise

  • Payment history or prior conduct indicates a risk to our staff or business

 

4. Service Booking and Cancellation

  • Appointments must be booked in advance through our website, phone, or authorised partners.

  • A minimum 24-hour notice is required for cancellations or rescheduling. Late cancellations may incur a fee of up to 50% of the service cost.

  • No-shows or cancellations on arrival will be charged in full.

  • We reserve the right to cancel or reschedule a service due to unforeseen circumstances, including weather, safety issues, or staff availability.

5. Pricing and Payment Terms

  • All pricing is subject to change without notice. Quotes are valid for 14 days unless otherwise stated.

  • Full payment is due on the day of service unless otherwise agreed in writing.

  • We accept EFTPOS, credit card, or bank transfer.

  • Invoices unpaid after 7 days may incur late fees of 5% per week and may be referred to debt collection agencies.

 

6. Client Responsibilities

 

To ensure a successful service, clients must:

  • Provide clear access to the property and ductwork

  • Secure pets and valuables

  • Notify us of any hazards, asbestos, or special requirements

  • Ensure someone over 18 is present during the service We are not responsible for delays, obstructions, or safety issues caused by non-compliance.

 

7. Warranties and Service Guarantees

 

We stand by the quality of our work. If you are not satisfied, please notify us within 48 hours of service completion. We will investigate and, if appropriate, return to rectify the issue. Our warranty does not cover:

  • Pre-existing damage

  • Mould or contamination that requires remediation beyond duct cleaning

  • HVAC repairs or replacement

 

8. Liability Limitations

 

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages

  • Our liability is limited to the total amount paid for the service

  • We do not guarantee allergen elimination or indoor air quality improvements beyond what is reasonably expected from duct cleaning

 

9. Intellectual Property

 

All content on our website, including logos, branding, text, graphics, and media, is the property of Doctor Clean Duct and may not be reproduced without written consent.

 

10. Privacy and Data Collection

 

We collect and use personal data in accordance with our Privacy Policy. By using our services, you consent to such collection and use.

 

11. Force Majeure

 

We are not liable for delays or failures in service due to events beyond our reasonable control, including but not limited to natural disasters, strikes, power outages, pandemics, or government restrictions.

 

12. Dispute Resolution

 

In the event of a dispute, both parties agree to attempt resolution through good faith negotiation. If unresolved, disputes will be submitted to mediation before pursuing litigation.

 

13. Governing Law

 

These Terms are governed by the laws of the State of Victoria, Australia. Any legal action must be brought in the courts located in Melbourne, Victoria.

 

14. Changes to Terms

 

We reserve the right to modify these Terms of Service at any time. Continued use of our services after changes are published constitutes your acceptance of the revised terms.
